ContentKing provides a web-based cloud application with real-time SEO auditing and change management to improve and maintain a website’s search engine visibility. The application enables you to perform SEO auditing, SEO monitoring, SEO alerting and SEO change tracking. In the course of our activities in relation to this application, we process personal data. ContentKing takes your privacy very seriously and handles all of your personal information with great care.

In this Privacy Policy, we inform you on how we process your personal data. We recommend that you read this Privacy Policy carefully.

Who and what is ContentKing?

If you are based in the USA, ContentKing (“ContentKing”, “we”, “us” or “our”) refers to ContentKing, Inc., having its address at 228 East 45th Street, Suite 9E, 10017 New York, NY, USA.

If you are based outside of the USA, ContentKing (“ContentKing”, “we”, “us” or “our”) refers to ContentKing B.V., having its address at Donauweg 10, 1043 AJ in Amsterdam, The Netherlands, registered with the Chamber of Commerce under registration number 63333996.

ContentKing is responsible for the processing of your personal data. All questions regarding the processing of personal data by ContentKing can be addressed to support@contentkingapp.com.

To whom does this Privacy Policy apply?

This Privacy Policy applies to you when you visit our website, www.contentkingapp.com (the “Website”), or use our application and related services such as our Microsoft Teams connector. Through our Website, you can obtain information about our application and related services, subscribe to and pay for our application, contact us, subscribe to our newsletter and apply for jobs. This Privacy Policy is also applicable to you when you participate as a virtual participant in one of our webinars.

What information does ContentKing collect and why?

We process your personal data for various purposes. We are only allowed to do this if we have a reason to do so (this is called a legal ground). In the overview below we indicate what personal data ContentKing uses for which specific purpose, what the legal ground is for processing this data, and for how long ContentKing stores the data. The retention periods mentioned in this Privacy Policy may be extended if needed to meet a statutory obligation, to the extent necessary to do so.

  1. Visits to the Website. When you visit the Website, we collect some technical information about your visit. For example, we collect the date and time of your visit, your IP address or other unique ID, the browser, the items you visit and other log information (such as the URL referrer and the country of the IP address). This personal data is necessary to allow the Website to function optimally and to display information in the desired manner. The processing of this personal data is thus needed in order for ContentKing to pursue its legitimate interests. We store your personal data between one and 50 month(s) from your most recent visit.

    We also collect information about your visits to our Website via cookies. You can find more information about the personal data about you that we process when you visit the Website in our Cookie Policy.

  2. Newsletters and other emails. If you are interested in our newsletters and/or other communications, you can subscribe to our monthly mailings here by providing your email address and clicking on “Subscribe”. We also send you “Feature Announcement” newsletters if you have started using our application (and you have not opted out to this). We may also send you automatically generated emails (such as a confirmation email).

    In addition to your email address, we also use information about the performance of the email, as well as your preferences following from your interaction with the email, to optimise the relevance and quality of the emails we send. These include the time the email was received and opened, the contents of the opened email, the hyperlinks clicked on, your IP address, your operating system, location, city and country and the browser you are using.

    We process your email address to send you email. The other personal data mentioned here is processed by ContentKing because it is important for us to keep improving our emails and services. The processing of this personal data is needed in order for ContentKing to pursue its legitimate interests.

    The personal data we process in the context of email tracking will be deleted as soon as possible after we receive any request from you to do so (explanation below). The email address and the data that shows that you have subscribed to the newsletter/are using our services will be deleted five years after you unsubscribe from the newsletter, as this is prescribed by the Dutch Authority for Consumers & Markets (“Autoriteit Consument & Markt”).

    If, at any moment, you do not wish to receive newsletters from ContentKing anymore, you can unsubscribe by using the opt-out option that is provided in every newsletter that ContentKing sends you. If you would like us to delete your data collected in the context of email tracking, you can follow the procedure as described below under “How can you exercise your privacy rights?”.

  3. Application. You can start a free trial of our application by filling in your email address. We will then register your email address and send you a confirmation email. After that, the application becomes accessible through a unique user account. You can later supplement your account information with your name, job title, and password, but this is not mandatory. We qualify as a data controller with regard to the generation of an account and your account information. The data you generate when using the application is processed by ContentKing on your behalf.

    The processing of the above-mentioned personal data is necessary for the performance of the user contract with you. Without this personal data no account can be created, and the application cannot be used. Please note that as a data controller, we use personal data derived from the application for support purposes and to improve the application as well. This personal data is processed for ContentKing’s legitimate interests.

    We store your personal data for as long as you have an account and will delete your data after you contact our customer support requesting its deletion.

  4. Webinars. When you participate in one of our weekly free webinars, we process your name, email address, company, professional title, email address and phone number.

    We use the personal data from you as a visitor to register you for webinar attendance, send an email to you to confirm your registration, send you information and materials regarding the webinar, provide you with updates/feedback regarding the event and contact you about future webinars. The processing of the personal data is therefore needed for ContentKing to pursue its legitimate interest to provide you with a tailored webinar.

    We retain your personal data for as long as we consider it necessary for the above mentioned purposes. For information on the retention period of personal data in the context of the update emails and newsletter, we refer you to “Newsletter and other emails”.

  5. Payments. When you decide to use our application (after the free trial) or attend a webinar, we ask you to fill in your billing details such as the company name, address, zip code, city, country, VAT number, billing email address and the payment method. We also administer data on the amounts for which you have made a purchase. We process this personal data in order to execute the agreement with you. Without this personal data, no payment can be made, and the application cannot be used. Pursuant to applicable law, we are also obliged to retain this financial data for a statutory retention period that is usually seven years.

    To process your payment, we use integration with a payment service provider. The payment is also made through this party. These payment service providers are in most cases responsible for the processing of your personal data. We thus advise you to look at the Privacy Statements of these service providers.

  6. Reviews. ContentKing publishes reviews from other websites on its own Website. Therefore in these cases we process your name, the content of your review and any information from your LinkedIn profile. The processing of this personal data is necessary for the purposes of the legitimate interests pursued by ContentKing, namely promoting the product. We remove your personal data as soon as we notice that your review is no longer present on the original website.

  7. Careers. We are always looking for talented people, and our open positions are shown on our Website. If you apply for a position at ContentKing, you can choose to send us an email or to apply via a web form on our Website. We will process your name, email address, information from your CV, motivation letter (references, list of marks, certificates etc.), portfolio and LinkedIn profile. We also consult other social media and related webpages, such as GitHub and Facebook, if that is necessary for the position for which you applied. The personal data we collect in the first phase of the application process is needed to assess whether you would be suitable for the position. The processing of this personal data is therefore needed for ContentKing to pursue its legitimate interests. ContentKing retains your personal data for four weeks after rejection or, with your consent, for a period of one year.

  8. Contact. We process personal data if you contact us via live chat, telephone or email, or via a web form (for example if you ask for a quote for our application). We will process any personal data that you fill in or provide to us (by telephone), such as your name, company, email address, phone number and the contents of your question or complaint. You can also share your user data with us. We use this personal data to ensure that we can answer your questions or respond to your complaint. The processing thereof is needed for ContentKing to pursue its legitimate interests. If you contact us to request a quote, we process your personal data at your request, because this is necessary prior to entering into a user contract with you.

    If you already have an account, this personal data is stored together with your personal data in relation to the Application. We refer you to the “Application” section for more information about the retention period. In other cases, ContentKing will delete your personal data in general within six months after responding to your message, resolving your complaint or sending you a quote, or for a longer period if we consider it necessary due to the nature of the question, complaint or quote.

  9. Other data processing activities. We process personal data if obliged to do so by supervisory authorities and inspection services, such as the Dutch Tax and Customs Administration (“Belastingdienst”) or the Dutch Data Protection Authority (“Autoriteit Persoonsgegevens”). This personal data is stored as long as necessary for these purposes or as prescribed by specific legal obligations.

Who has access to your personal data?

The following third parties have access to your personal data.

  1. The ContentKing group. We share your personal data within our group and/or with third parties, if necessary and to the extent this is necessary for the purposes described in this Privacy Policy. We may for example share your personal data with the ContentKing group’s companies when this is necessary to fulfil your requests as well as to provide services and customer support. If you are a job applicant, we will provide the information in your application to the ContentKing entity pertaining to the job location mentioned in the job description.

  2. Processors. We engage parties that process personal data on our behalf (processors), for example to send out newsletters. A list of our processors can be found here.

  3. Other third parties. ContentKing provides your personal data to external parties that each (partly) act as a data controller. This is the case, for example, to process your payments. Because these third parties are (partly) responsible for processing your personal data themselves, they must inform you of this themselves. We may also transfer your personal data in the event that we merge with or are acquired by a third party or should any such transaction be proposed.

  4. Authorities and legal-aid counsellors. We may also share personal data with external parties if ContentKing is required to do so on the basis of applicable laws and/or regulations, such as by the police and government institutions. ContentKing can also share personal data on the basis of a court order or judicial decision or with your consent.

Does ContentKing process your personal data outside the European Economic Area?

Some of our service providers (data processors) and group entities are established in a country outside the European Economic Area (“EEA”), namely the United States. An overview of the countries of our data processors can be found here.

In order to comply with EU data protection legislation for international transfers, we carefully consider whether an adequate level of protection can be guaranteed. Where necessary, we set forth arrangements in a data transfer agreement based on existing standard contractual clauses (opens in a new tab) or adequacy decisions (opens in a new tab) adopted by the European Commission. We also try to take additional measures to protect personal data, such as applying encryption and pseudonymization. In all cases, we make every reasonable effort to adequately protect personal data, following the latest policies and guidelines.

How can you exercise your privacy rights?

Under privacy law, you have a number of rights with regard to your privacy.

  1. Right to access. This is the right to ask us if we have personal data from you and to have access to it.
  2. Right to rectification. You have the right to request the rectification of inaccurate personal data concerning you.
  3. Right to be forgotten. In some cases, you have the right to ask ContentKing to erase your personal data.
  4. Right to restriction. You have the right to restrict the processing of your personal data or to stop such processing temporarily.
  5. Data portability. This is the right to receive your personal data that you have provided to us in order to transmit this data to another controller.
  6. Right to object. You have the right to object to the processing of personal data. Where personal data is processed for direct marketing purposes, you always have the right to object to the processing of personal data for such marketing.
  7. Withdrawal of consent. Where the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

You may send your requests in these matters to support@contentkingapp.com. ContentKing will respond to your requests within one to four weeks. That period may be extended by two further months where necessary to respect the complexity and number of the requests. ContentKing shall inform you of any of such extension within one month of receipt of the request, together with the reasons for the delay. If we do not take action on your request, we shall inform you of the reasons for not taking action.

Can this Privacy Policy be changed?

We may amend this Privacy Policy in the future. If there are substantive or material changes that may affect one or more of the parties involved to a significant extent, we will inform those involved in advance. Our changed Privacy Policy will also be available on this webpage, so it is recommended to regularly take a look at this page.
